These terms of use ("Agreement") are a legal and binding agreement between you as the User and Unknotd Private Limited and/or its affiliates (“GARDMEI”). This Agreement governs your use of the Gardmei Application and Services. By registering on or using the Application/Service, you acknowledge you have read and understood this Agreement and agree to be bound by it.

1. SCOPE OF SERVICE

Gardmei is a digital facilitation platform for consumers and organizations to verify, sell, buy, and transfer ownership of used electronic devices.

Facilitation: Gardmei provides tools for the physical verification and manual inspection of devices during a transfer.
Physical Handover: The core service involves a physical meeting or coordination between parties to inspect the hardware and confirm the transfer.

2. SUBSCRIPTIONS AND SERVICE FEES (PAYMENT POLICY)

To ensure compliance with global app distribution standards, Gardmei operates on a multi-platform service model:

  • Vendor Subscriptions (Website Only): Professional vendor subscriptions and monthly plans are managed and purchased exclusively through our official website (www.gardmei.com). In line with standard multi-platform practices (similar to Spotify), these subscriptions cannot be purchased directly within the mobile application. Once a subscription is active on the website, the features will be unlocked in the mobile app.
  • Transaction Service Fee (In-App): A nominal service fee of ₹25 is charged for each device transfer.
  • Nature of Fee: This fee is specifically for the physical coordination, manual inspection, and on-the-ground verification of the device during the handover process.
  • Payment Method: As this is a fee for a Physical Service (not digital content), it is processed via our integrated payment gateway (Razorpay).
  • Refunds: All service fees and subscriptions are non-refundable once the verification process has been initiated or the subscription period has started.

3. DATA PRIVACY AND TRACKING

  • No Tracking: GARDMEI does not track users across third-party applications or websites for advertising purposes.
  • No Location Tracking: We do not collect, store, or monitor your real-time or background location data.
  • Data Usage: Personal information (Name, MSISDN, Email) and Financial Information are used strictly for account functionality, security, and payment processing for physical services.

4. USER RESPONSIBILITY & REQUIREMENTS

  • Registration: Users must register via mobile OTP. Creating an account is free.
  • Authentication: Users must provide valid government ID proofs for KYC to ensure the authenticity of the legal ownership transfer.
  • Accuracy: You warrant that all device information (IMEI, Brand, Condition) provided by you is accurate and truthful.

5. LIABILITY DISCLAIMER

Gardmei is a facilitator and is not responsible for any warranty claims, product defects, fraud, or losses arising between the transacting parties after the physical handover.
We shall not be liable for unauthorized access to personal data, subject to the provisions of the Information Technology Act, 2000 and the Digital Personal Data Protection Act (DPDPA), 2023.

6. APPLE APP STORE SUPPLEMENTAL TERMS

  • Acknowledgment: This Agreement is between the User and GARDMEI only, not Apple Inc.
  • Maintenance: GARDMEI is solely responsible for app maintenance and support; Apple has no such obligation.
  • Warranty & Claims: GARDMEI is responsible for addressing any claims relating to the app. In case of warranty failure, Apple’s liability is limited to the refund of the purchase price (if any).
  • Third-Party Beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement and have the right to enforce it against you.
